Lawsuits Challenging NCAA’s Caps on Scholarships Will Proceed, Judge Rules

Two lawsuits challenging the ability of the NCAA to cap scholarships will proceed in court, a U.S. District Court judge ruled on Thursday. Judge Claudia Wilken, who in August sided with the plaintiffs in the landmark case O’Bannon v. NCAA, denied a motion by the NCAA and 11 athletic conferences to dismiss the two suits.

The first suit was brought by the prominent antitrust lawyer Jeffrey L. Kessler, who argues that free-market principles should govern player compensation. The second was brought by the former West Virginia University running back Shawne Alston, and others, who are suing for class-action damages.
